Terms, conditions and web site use

The use of this web site is conditional upon your acceptance, without modification, of all terms and conditions provided below. Your continued use of this web site communicates your acceptance of these terms.

The following terms and conditions apply to all programs provided by Malouines South Atlantic. Because of the different weather conditions, wildlife, location, and political status of each location featured in our Travel Packs, additional terms and conditions will apply for each destination, and are listed below.

Malouines South Atlantic is a division of Petit-House.

We reserve the right to make changes to this web site and this document at any time.

All content included on this site, but not limited to, text, graphics, logos and software, are the property of Malouines South Atlantic or its content suppliers. Otherwise noted, all images are property of Malouines South Atlantic, and are protected by international copyright laws.

This web site, or any portion of this web site, may not be reproduced, duplicated, copied, sold, resold or exploited for any commercial purposes that are not expressly granted by Malouines South Atlantic.

All information, software, products and services published on this web site may include inaccuracies or typographical errors.

While we make all reasonable attemps to ensure the accuracy of the information on this web site, neither Malouines South Atlantic nor its providers can be held responsible by the customer for the accuracy of the information provided.

Responsability

Our services do not include Medical Insurance or Life Insurance.

Our services may take place on very remote regions, away from big cities, where no complex health-related situations can be taken care of. Some accidents may require emergency avacuation by plane or helicopter. All passengers traveling with us are required to be covered by a travel insurance policy that includes emergency evacuation coverage.

Each passenger is responsible for his/her actions. Malouines South Atlantic, nor its agents, assume any liability whatsoever for any damage, loss, accident, death, or delay to persons or property in consecuence of passenger's actions.

Malouines South Atlantic, acts only in the capacity of agents in matters relating to travel and do not assume any liability whatsoever for any damage, loss, accident, death, or delay to persons or property due to an act of default of any hotel, carrier, restaurant, company or person rendering any of the services included in the tour, or by act of God.

The cost of delays is not included, in the event that bad weather, road conditions, transportation delays, government intervention, sickness, labor strikes, equipment malfunction, force majeure, or any other contingency for which Malouines South Atlantic, or its agents, cannot make provision, occurs. Malouines South Atlantic assumes no responsability for the aforementioned cost of delays.

Please insure that you have all necessary documents to travel. No refunds or changes will be made if clients are denied boarding for not being in possession of proper travel documents. Malouines South Atlantic is not responsible for lost or stolen documents.

Payments and itinerary changes.

Cash, bank transfers and credit cards (Visa, MasterCard, American Express) are accepted. Bank charges are 3%, and credit card charges are 5%.

Payments:
(not including credit card/bank charges)

Travel packages to the Falkland Islands
A 30% of the total cost is required 15 days after booking is confirmed. Final payment is due 90 days prior to departure.

Travel packages to South Georgia or the South Sandwich Islands
A 30% of the total cost is required 15 days after booking is confirmed. Another 30% must be paid 5 months prior to departure. The remaining 40% is due 60 days prior to departure.

Travel packages to the interior of Antarctica
A 35% of the total cost is required 15 days after booking is confirmed. Final payment is due 4 months prior to departure.

Cruises
A 30% of the total cost is required 15 days after booking is confirmed. Final payment is due 90 days prior to departure.

Prices are final once we recieve final payment.

There will be a 50 US Dollar charge for any change once booking is confirmed, plus charges imposed to us by airlines, hotels and/or providers.

Refunds and Cancellations


All cancellations must be e-mailed.

Refunds:
(not including credit card/bank charges)

Travel packages to the Falkland Islands

When notified 60 days before departure or more - 70% of total cost will be refunded.
When notified 30 days before departure or less - 60% of total cost will be refunded.
When notified less than 30 days before departure, no refund will be made.

Travel packages to South Georgia or the South Sandwich Islands
When notified 4 months before departure or more - 70% of total cost will be refunded.
When notified 45 days before departure or less - 40% of total cost will be refunded.
When notified less than 45 days before departure, no refund will be made.

Travel packages to the interior of Antarctica
When notified 4 months before departure or more - 65% of total cost will be refunded.
When notified less than 4 months before departure, no refund will be made.

Cruises
When notified 3 months before departure or more - 80% of total cost will be refunded.
When notified less than 3 months before departure, no refund will be made.

Please contact us for airlines' payment policies.

No partial refunds will be given for unused hotel rooms, meals, sightseeing trips or other activities for any reason whatsoever. Credits are not given for specific services not used once the trip has started.

Malouines South Atlantic reserves the right to cancel any trip due to unforseen circunstances with local outfitters, agents or others. In such case, a full refund of trip cost is given. Malouines South Atlantic is not responsible for additional expenses incurred by passengers in preparing the trip (i.e. visa fees if applicable, equipment, medical expenses, etc.).


Personal Information

We will not ask you for information that does not have a purpose and we will not require information to be disclosed that is not absolutely necessary. Malouines South Atlantic is the sole owner of the information collected. We will not sell or rent your information to others.

Except as required by law, personal information will not be revealed to third parties.

Our agents may take photographs during the trip. Passengers extend Malouines South Atlantic permission to take their photograph during the trip and release all rights over those images. Passengers who do not wish to be photographed must inform Malouines South Atlantic prior to departure.

IMPORTANT:

MALOUINES SOUTH ATLANTIC, HAD NEVER, AND WILL NEVER BE PART OF ANY DEBATE OR DISPUTE ON THE FALKLAND ISLANDS AND SOUTH ATLANTIC TERRITORIES SOVEREIGNTY.
MALOUINES SOUTH ATLANTIC, HAD NEVER, AND WILL NEVER HAVE POLITICAL INTENTIONS OF ANY KIND.
REMEMBER THAT YOU ARE THE ONLY RESPONSIBLE FOR YOUR ACTIONS, AND THESE ACTIONS MAY LEAD TO DETENTION AND DEPORTATION. NO REFUNDS OR CREDIT WILL BE GIVEN FOR SERVICES LOST IN CONSECUENCE OF PASSENGERS ACTIONS.

Responsible Tourism Code

- Always ask permission before entering private land.

- Keep to paths wherever possible. Leave gates open or shut as you find them.

- Be aware of the high fire risk throughout many places visited. Be extremely careful when smoking not to start fires. Take cigarette butts away with you. Some places have a strict policy against smoking.

- Do not dop litter. Take your rubbish home with you.

- Do not disfugure rocks or buildings.

- Do not touch, handle, injure or kill any wild bird or other wild animal.

- Never feed any wild animals.

- Always give aniamls the right of way. Remember not to block the routes of seabirds and seals coming ashore to their colonies.

- Try to prevent any undue disturbance to wild animals. Stay on the outside of bird and seal colonies. Remain at least 6 m (20 ft) away (some animals may need more distance not to be disturbed). When taking photographs or filming stay low to the ground.

- Do not startle or chase wildlife from resting or breeding areas.

- Some plants are protected and should not be picked. Wildflowers are there for all to enjoy and should be left where they are found.

- Whalebones, skulls, eggs, battlefield items or other such items may not be exported and they should be left where they are found.

- Remember some penguins nest underground, so watch you step, you could destroy their homes or twist your ankle. Never put your hand into penguin borrows, they contain fleas, and penguins will bite.

- Never get between a sea mammal and the sea.

- Such actions may constitute an offence and could result in fines up to 6000 US Dollars.

- Use common sense.


ADDITIONAL TERMS AND CONDITIONS

A - FALKLAND ISLANDS

Travel Requirements (travel documents)

Travel Packs "Falklands Basic Program", "Meet the Falklands", "Island Traditions", "History and Nature", and "Falklands Full Explorer":
1.- Passport, valid for at least 6 months before departure. No visa is required for citizens of the EC, Mercosur, USA or the British Commonwealth wishing to obtain a temporary visitor’s permit. A visitor’s permit valid for the duration of your stay (with a maximum initial validity of one month) will be issued free of charge on arrival in the Falklands. Citizens from other countries should check with their nearest British Consul before travelling.
2.- Return air ticket or other evidence of prepaid onward travel arrangements, and pre-arranged accommodation in the Islands in advance of their arrival .
3.- Evidence in the form of cash or major credit card will be required of sufficient funds to cover the expected length of stay in the Falkland Islands.
4.- All passengers are required to be covered by a travel insurance policy that includes emergency evacuation coverage.

Booking Conditions - Falkland Islands

Passengers are aware of the sovereignty conflict over the Falkland Islands, South Georgia and South Sandwich Islands between Argentina and the United Kingdom, and accepts that any type of provocation, flags, paintings, songs, violent expressions, etc., in relation, whether in favor or against any of the parts involved, could be received as an aggresion, and could even cause detention and subsequent deportation any individual involved.

WARNING:
Some 117 minefields remain in the Falkland Islands. Do not attemp to enter any minefield, any marked "suspect area", or remove its signs. It's a crime to do so, with severe penalties and fines of up 2000 Us Dollars.

B - SOUTH GEORGIA AND SOUTH SANDWICH ISLANDS

Travel Requirements (travel documents)

Travel Packs "South Georgia Expedition" and "South Sandwich Expedition":
1.- Passport, valid for at least 6 months before departure. No visa is required for citizens of the EC, Mercosur, USA or the British Commonwealth.
2.- Visitor’s permit (to be issued through Malouines South Atlantic).
3.- All passengers are required to be covered by a travel insurance policy that includes emergency evacuation coverage.

Travel Pack "Antarctica, South Georgia and the Falkland Islands":
1.- Passport, valid for at least 6 months before departure.
2.- All passengers are required to be covered by a travel insurance policy that includes emergency evacuation coverage.

Booking Conditions - South Georgia and the South Sandwich Islands

Travel Requirements (travel documents)

Travel Packs "Emperors in Antarctica", "Diving Antarctica" and "Antarctica, South Georgia and the Falkland Islands":
1.- Passport, valid for at least 6 months before departure.
2.- All passengers are required to be covered by a travel insurance policy that includes emergency evacuation coverage.

Travel Packs "Ski to the South Pole: The Last Degree" and "Antarctic Odyssay":
1.- Passport, valid for at least 6 months before departure.
2.- Visitor’s permit (to be issued through Malouines South Atlantic).
3.- All passengers are required to be covered by a travel insurance policy that includes emergency evacuation coverage.

Booking Conditions - Antarctica

Travel Packs "Ski to the South Pole: The Last Degree" and "Antarctic Odyssay", require the agreement of additional terms and forms related to passenger's phisical condition and health. These documents will be provided by Malouines South Atlantic before booking.

D - SOUTHERN PATAGONIA AND TIERRA DEL FUEGO

Travel Requirements (travel documents)

All Travel Packs taking place in Argentina:
1.- ID (Argentina, Chile, Uruguay, Brazil, Paraguay and Bolivia). Passport, valid for at least 6 months before departure and visa if necessary.
2.- All passengers are required to be covered by a travel insurance policy that includes emergency evacuation coverage.

All Travel Packs taking place in Chile:
1.- ID (Argentina, Chile, Uruguay, Brazil and Paraguay). Passport, valid for at least 6 months before departure and visa if necessary.
2.- All passengers are required to be covered by a travel insurance policy that includes emergency evacuation coverage.
